Municipal Court Violations
Motor vehicle violations including speeding, careless driving, reckless driving, illegal turns, and red light violations all carry motor vehicle points. The accumulation of points may result in surcharges being assessed and licenses being revoked. Our offices have been successful in amending these charges to less serious violations in order to avoid these consequences. Other charges such as driving without insurance or driving on the revoked or suspended list can result in substantial loss of driving privileges as well as incarceration. We have frequently been able to avoid these penalties by pursuing all possible defenses and by entering into substantive plea negotiations with the Prosecutor's office.
Driving Under the Influence (DUI)
Drunk driving is considered the most serious motor vehicle violation. The minimum mandatory penalties for even a first offense are substantial and can include fines, incarceration, and a loss of driving privileges for a minimum of three months or seven months depending on the seriousness of the charge. Since Courts are under a mandate by the Supreme Court to resolve all DWI cases within sixty days of the offense, it is strongly recommended that legal representation be sought immediately. Evidence must be obtained without delay in order to determine whether any viable defenses exist. On occasion, the results of the breathalyzer test may be challenged. Other times, Motions may be filed in order to challenge the basis for the initial motor vehicle stop or the actual arrest by the police officer.
